MUNICIPALITY OF ALLEYN AND CAWOOD
 
CALL FOR TENDER
 
WINTER ROAD MAINTENANCE FOR THE 2016/2017, 2017/2018, 2018/2019
 
The Tenderer must conform with all the norms and conditions of the following specifications or the Tender shall be rejected.
 
1.             DESTINATION OF THE TENDER
 
Tenders to be opened in public by the Municipal Council of Alleyn and Cawood at a special council meeting on Monday, April 4th, 2016 at 7:30 p.m. unless otherwise notified.
 
A copy of the Tender along with all the requested documents must reach the Secretary-Treasurer at the Municipal Office by 3:00 P.M. on Friday, March 31st, 2016 , and a duly authorized receipt will be issued to the bearer.
 
2.             CONTENTS OF THE TENDER FORM
 
The Tender form must preferably be filled in by typewriter or very clear handwriting and returned duly signed, exclusively in a sealed envelope indicating, “TENDER - WINTER ROAD MAINTENANCE FOR THE 2016/2017, 2017/2018, 2018/2019 SEASONS”
 
One may obtain additional forms at the Municipal Office during normal office hours.
 
3.             BUSINESS OFFICE NOTICE
 
Each Tenderer must indicate below, the address of his office where all notices, mail and other documents regarding his Tender and eventual Contract should be mailed, delivered or notified.

4.             PRICE
 
The Tenderer MUST indicate below the firm price of his tender per kilometer.
 
Only Tenders containing firm prices shall be considered;

5.             EQUIPMENT
 
The Tenderer must have a minimum of two (2) trucks equipped with plow and wing, available to work at snow removal for 44.3 Kilometers of road.
 
AND
 
The Tenderer must have a minimum of one (1) sand/salt spreader available and working at spreading a sand /salt mixture for 44.3 km. of road whenever and wherever road conditions require such application or upon request of the Municipality’s road committee.

Proof of ownership or leasing must be submitted 48 hours prior to the signing of the contract.
 
Proof of insurance for a minimum of $2,000,000.00 must be submitted 48 hours prior to the signing of the contract.
 
6.             DELAY OF DELIVERY
               
                Delivery of services as specified in the contract to intervene between the parties is one of the
                essential conditions of the contract and the non-conformity will annul the contract automatically
                to the Municipality’s convenience without the necessity for a formal notice or to go to law.             
 
 
7.             LOCATION OF MACHINERY
 
The Tenderer shall indicate below the place where the machinery, equipment, sand and salt shall be available:

8.             PERFORMANCE BOND
                               
Upon signature of a contract, the Tenderer agrees to provide, at his own expense, a Performance Bond or a Bank Letter of Guarantee to guarantee to the Municipality if, for any reason , the Tenderer is unable to complete the contract, the value of that Bond must be 50% of this contract.
 
The Tenderer must submit with the present, proof that such a Performance Bond or Bank Letter of Guarantee can be issued on his behalf for a value of 50% of the contract to intervene.
 
The tenderer must submit with the present, a certified cheque on his behalf for the value of $10,000.00 which will be returned upon signing of contract.
 
9.             PROOF OF INSURANCE AND WORKER’S COMPENSATION
 
The Tenderer will be responsible for any damage caused by his actions in the execution of the present contract or for any damage caused by his employees and equipment used by them in the execution of their duties related to this contract.  The Tenderer hereby agrees to arrange to cover his responsibility for damage with an insurance policy for $2,000,000.00 and agrees to provide a copy of such insurance policy or proof to said Municipality 48 hours prior to the signing of the contract.
 
Moreover, the Tenderer must submit proof, with the present, that he is conforming in all respects to and with the laws and regulations as set out by the Worker’s Compensation Act, if applicable.
 
 
10.          NON-CONFORMABLE TENDERS
 
The Tenders not in conformity with the norms and conditions of these specifications and not accompanied by all documents required in proper form and sealed in an envelope specifically marked “TENDER - WINTER ROAD MAINTENANCE FOR THE 2016/2017, 2017/2018, 2018/2019 SEASONS”, shall be rejected.
 
 
11.          SELECTION OF THE TENDER
 
The Municipality of Alleyn and Cawood reserves its privilege to accept neither the lowest nor any tenders received and the Tenderer, by signing the present, renounces to any suits or claims for fees or losses suffered by him against the Municipality of Alleyn and Cawood and its Council.
 
12.          After acceptance of  his bid, if the Tenderer does not sign the contract presented to him by the        Municipality of Alleyn and Cawood before 3:00 P.M. on  October 14th, 2016,  the
                Municipality reserves its right to proceed with the next qualified Tender.
 
13.          The Tenderer accepts all of the above-noted and declares to be empowered with all the necessary
                authority to sign the present.
